TRAVEL AI TERMS AND CONDITIONS OF USE

📋1. IDENTIFICATION DATA
In compliance with Law 34/2002, on Information Society Services and Electronic Commerce (LSSI-CE), it is hereby informed that the ownership of the "Travel AI" application (hereinafter, the "App") belongs to:

🎯2. PURPOSE AND FUNCTIONALITY
Travel AI is a digital tool that allows users to identify artworks and monuments using the mobile device camera and Artificial Intelligence (AI) technologies, manage a personal collection of visited works, and discover cultural points of interest through geolocation.
🤖3. USE OF RECOGNITION TECHNOLOGY (AI)
Nature of the service:
The user acknowledges that artwork identification is performed using Artificial Intelligence algorithms. Although the system seeks maximum accuracy (confidence), 100% accuracy in results is not guaranteed. The Owner is not responsible for erroneous identifications or inaccurate historical information provided by the system.
Image capture:
When using the "Camera" function, the user guarantees that captured images do not infringe on third-party privacy rights (e.g., photographing people in the foreground without consent) or intellectual property rights restricted by specific private museum regulations.
👤4. REGISTRATION AND ACCOUNT
To use certain functions (save collections, Premium), registration is required. The user is responsible for safeguarding their credentials.
Account deletion: The user may request account deletion at any time from the App. This process is irreversible and will anonymize associated data, in accordance with our Privacy Policy.
💳5. SUBSCRIPTIONS AND PAYMENTS
The App offers payment methods processed through the secure Stripe gateway.
5.1. Travel Pass (One-Time Payment):
- Access to Premium features for 7 calendar days.
- It is a one-time payment that does not automatically renew.
- It expires automatically at the end of the period.
5.2. Recurring Subscriptions (Monthly/Annual):
- They automatically renew at the end of the billing period (month or year) unless canceled.
- Cancellation: The user may cancel the subscription at any time. Cancellation will be effective at the end of the current billing period. The user will maintain Premium access until that date. No partial refunds are made for unused periods.
5.3. Right of Withdrawal:
Since this is digital content (software and database access) that runs immediately, the user acknowledges that they lose their 14-day right of withdrawal once they have started enjoying the service (immediate activation after payment), in accordance with art. 103 of the TRLGDCU.
©️6. INTELLECTUAL PROPERTY AND USER CONTENT
Of the App:
The software, design, database, and algorithms are the exclusive property of the Owner.
Of the User:
The user retains rights to the photos they take. However, by uploading an image for recognition, they grant the Owner a worldwide, non-exclusive, royalty-free license to process said image for the purpose of providing the service.
AI Improvement:
If the user explicitly accepts the "Allow Data Collection" option, they authorize the Owner to use images (in anonymized form) for training and improving artificial intelligence models.
📍7. GEOLOCATION
For the "Explore" function and nearby recommendations, the App requires access to GPS location. The user may revoke this permission in their device settings, although this will limit the App's functionality.
⚠️8. EXCLUSION OF WARRANTIES
The service is provided "as is." Uninterrupted server availability and absence of API errors are not guaranteed.
⚖️9. APPLICABLE LAW AND JURISDICTION
These terms are governed by Spanish law. For any dispute, if the user acts as a consumer, they will submit to the courts of the user's domicile.
